Definitions
The ‘Seller’ means Dataserv-ces Ltd.
The ‘Buyer’ means any person, firm or company who buys or agrees to buy a product
from the Seller.
Conditions Applicable
These conditions shall apply to all orders and contracts for the sale of
products by the Seller to the Buyer to the exclusion of all the other terms
and conditions unless confirmed in writing to the seller.
Prices
The prices for the products as set out on this web site are shown inclusive
of VAT. Prices are correct at the time of the web page
being built but may be subject to change without notice.
The Buyer will pay for the products (including VAT and carriage) at the time of the order and payment is accepted by the methods shown in ‘FAQ’.
The Buyer shall make all arrangements necessary to take delivery of the products whenever they are tendered for delivery. Risk in the products shall pass on delivery.
Any delivery date or time quoted is not guaranteed and the Seller will not be liable for any failure to meet delivery dates nor for loss or consequential loss of any kind arising from a delay in delivery howsoever caused.
Trademarks
All trademarks are acknowledged as belonging to the registered owner.
Retention of Title
The products shall remain the property of the Seller until payment is made
in full.
Until such time as property in the products passes from the Seller to the Buyer, the Buyer shall upon request deliver up the products supplied to the Buyer and if the Buyer fails to do so the Seller may enter upon any premises owned or occupied or controlled by the Buyer where the products are situated and repossess the products.
Exclusions
All terms, conditions and warranties (whether implied or made expressly)
whether made by the seller or his agents or otherwise relating to the quality
and/or fitness for the purpose of the products are excluded. The Seller shall
be under no liability whatsoever to the Buyer for any indirect loss and/or expense
(including loss of profit) suffered by the Buyer arising out of a breach by
the Seller of this contract.
In the event of any breach of this contract by the Seller the remedies of the
Buyer shall be limited to damages and in no circumstances shall the liability
of the Seller exceed the price of the products.
Statutory Rights
This contract does not in any way affect the Buyer’s statutory rights under
the laws of England and Wales.
Choice of Law
This contract is subject to the law of England and Wales.
